Please try a thought experiment:
If drug traffickers are on American soil, should they be assumed to be enemy combatants subject to being shot on sight? If not, it seems the only thing that turns them into enemy combatants, if they are at sea in a boat, is that their location is in a place where they pose less of an immediate threat. Does that make sense?
