Additionally, those convicted of heinous crimes, torture, terrorism, racism, violence against women, drug trafficking, and organized crime are also excluded. The decree bars the benefit from those who have signed cooperation agreements, known as delations, or are serving time in maximum-security prisons. The requirements for granting the pardon vary depending on the sentence profile, such as the length of the sentence, recidivism, use of violence, and time served. The decree also granted pardon to women in specific circumstances, such as mothers and grandmothers with children under 16 years old or with disabilities and prisoners under 21 years old or over 60 years old. In these cases, at least one-eighth of the sentence must be served.
