This is inside baseball, but to me, there are three ways in which this development *bears out* Justice Jackson's unusual intervention Friday night—about which there was much confusion. First, this makes it clear that a majority of the Court was *not* going to force the USDA to fund SNAP by Friday. View quoted note →
Indeed, the text of the order doesn’t include the usual “and by her referred to the Court.” So Jackson clearly got overruled here. https://amanita.us-east.host.bsky.network/xrpc/com.atproto.sync.getBlob?did=did:plc:nwnlnixtjh3qhkwpz2uy5uwv&cid=bafkreie57ikekngq62gkeexuwdgvrpe5kmvc7f2x3ohhuzownq7okrfpvu
In other words, the Court is trying to buy itself two more days to see if the House approves the shutdown deal (which may well moot this case), rather than having to rule *now* on whether USDA can be forced to fully fund SNAP for November. And KBJ objects because she’d just deny the application now.
#BREAKING: Over a public dissent from Justice Jackson, #SCOTUS *extends* the temporary pause of the district court’s order that had mandated full SNAP payments for November—keeping that ruling (and those payments) on hold through the end of the day this Thursday: https://amanita.us-east.host.bsky.network/xrpc/com.atproto.sync.getBlob?did=did:plc:nwnlnixtjh3qhkwpz2uy5uwv&cid=bafkreie57ikekngq62gkeexuwdgvrpe5kmvc7f2x3ohhuzownq7okrfpvu

At 11:54 p.m. ET, the First Circuit *denied* the Trump administration's request for a stay pending appeal in the SNAP case. #SCOTUS now has 48 hours (so, through 11:54 p.m. on Tuesday) to either grant the same relief or extend the "administrative stay" entered by Justice Jackson on Friday night.
