He gets the purpose of Section 230 wrong. He gets the history of 230 wrong. He misrepresents how defamation law works. He misunderstands the incentives Section 230 creates (and the incentives repealing it would create) & he wraps it all in a single manipulative anecdote, leaving out crucial details
He gets multiple basic facts wrong, including easily fact-checked things about the law. And while he announces that he's open to learning, he admits that he hasn't done the most basic background work one would do before advocating.
I hope that Brian will slow down and perhaps speak to some actual legal experts like @jkosseff.bsky.social @ericgoldman.bsky.social @jmiers230.bsky.social @cathygellis.bsky.social @berinszoka.bsky.social @daphnek.bsky.social @klonick.bsky.social before continuing to misrepresent the law.
I wouldn't normally devote 5k+ words to a single podcast, but I'm hoping Reed will read it and think carefully about what he's doing. He has tremendous, well-earned respect among journalists. And I don't understand why he appears to be lighting it on fire.
