βUnder customary law, individuals had reciprocal incentives to recognize their rules of obligation and to participate in enforcement of such rules. The adversarial nature of authoritarian law that pits group against group in the taking/transfer process promotes disorder rather than order. Indeed, under government law, individuals have incentives not to participate in a cooperative effort to maintain order.β
