FARGO, N.D. (Valley News Live) - "A provision in the federal government’s spending package would restrict Minnesota’s hemp-derived THC industry by capping THC content at 0.4mg per container.
The U.S. Senate voted 76-24 on Monday to advance the provision, which now goes to the House for a vote as early as this week. The measure was championed by Sen. Mitch McConnell and opposed by Sen. Rand Paul.
The provision would reverse what McConnell called a “loophole” in the 2018 Farm Bill that inadvertently legalized hemp-derived THC products. The 2018 law removed hemp from the controlled-substance list and defined hemp as any cannabis plant or product with 0.3% or less THC.
Industry impact
Minnesota’s hemp-derived THC industry generates $140 million in retail sales. Current Minnesota law, passed in 2022, permits 5mg THC drinks and edibles for adults over 21.
The federal cap would effectively ban current products, which contain at least 2mg of THC even at the lowest doses.
Business concerns
If the provision passes, businesses selling hemp-derived THC products would face the same restrictions as cannabis businesses, including:
- Higher taxes under federal tax code Section 280E
- Limited access to banking and credit card services
- Cash-only operations"
