Separation of church and state should cover this. Marriage is a church thing, not a state thing. If people want unconventional marriages, form a new church to do them. The church of Satan exists... I'm not saying people should go to it, but its existence proves a point - you can form any church and believe anything. It also proves that Christians would prefer to allow criminals to rule them and violate the Constitution than admit that people have a right to believe things they don't agree with.
True. That case demonstrated that government doesn't know what marriage is. The fact the governments began granting divorces decades earlier also showed this.
If the government stopped granting marriage licenses, it would just rewrite the laws to recognize existing marriages, same as it does with common law marriages.
It would mean libertarians wouldn't be able to avoid marriage laws by refusing to get a license.
But how will they file for taxation theft then? Single filing?
